インターナショナル寺子屋 参加規約

本規約は、「インターナショナル寺子屋」(以下「当寺子屋」)において、利用者が各コンテンツ主催者(以下「主催者」)が運営するコースを受講するにあたって、生徒と当寺子屋および主催者との間に生じる一切の関係に適用されます。

第1条 (インターナショナル寺子屋について)

1.当寺子屋は21世紀の新たな学びの場として立ち上がった"コミュニティプロジェクト"です。かつて、街が人を育て、おとなと子どもが同じコミュニティで学んだように、行政や学校ではできない、多世代、多人種が共に学べる機会をご提供することを目的としてスタートいたします。
2.当寺子屋の業務運営は、インターナショナル寺子屋事務局(以下「寺子屋事務局」)がこれを担います。
3.寺子屋事務局は、主催者に代わりコース運営に関する以下の業務を行います。

  • (1)生徒募集および登録受付業務
  • (2)参加費代行回収業務
  • (3)当寺子屋WEBサイト運営管理、リーフレット企画制作
  • (4)その他、上記に付帯する業務

第2条 (コンテンツ主催者について)

1.当寺子屋においてコースを開設し、生徒に対し講義を提供する者を「コンテンツ主催者」といいます。
2.各コース内容の決定、講師の手配および安全管理等、運営上の一切の責任は主催者がそれを有します。

第3条 (受講資格)

1.当寺子屋にて、主催者が提供する講義(以下「講義」)に参加する者を「インターナショナル寺子屋生徒」(以下「生徒」)といいます。
2.生徒は、本規約に同意の上、所定の手続きによる申込、参加登録及び参加料の払い込みを行い当寺子屋がその登録を承認した者が、その資格(以下「参加資格」)を有します。
3.生徒は、当寺子屋利用中および卒業後も、当寺子屋を利用する場合には本規約に定める規定に従うものとします。

第4条 (受講資格の停止)

1.当寺子屋は、生徒が以下の項目のいずれかに該当する場合、当該生徒に事前に通知することなく、直ちに参加資格の停止(退学)をできるものとします。

  • (1)当寺子屋への申告、届け出内容に虚偽があった場合。
  • (2)過去に本規約違反などにより受講資格停止処分されている事が判明した場合。
  • (3)理由の如何に関わらず、当寺子屋の運営に支障があると当寺子屋が判断した場合。
  • (4)本規約に違反した場合。
  • (5)その他、当寺子屋が生徒として不適格と判断した場合。

2.当寺子屋が前項の措置をとったことにより、当該生徒が当寺子屋を利用できなくなり、これにより当該生徒または第三者に損害が発生したとしても、当寺子屋は一切の責任を負いません。また、前項各号の各項に該当する行為によって当寺子屋および第三者に損害が生じた場合、参加資格を停止された後であっても、当該生徒はすべての法的責任を負うものとします。

第5条 (禁止事項)

1.生徒は、コースに参加するにあたって、以下の行為を禁止します。

  • (1)生徒、第三者、もしくは当寺子屋の権利を侵害し、または侵害するおそれのある行為。
  • (2)生徒、第三者、もしくは当寺子屋のプライバシーを侵害する行為。
  • (3)生徒、第三者、もしくは当寺子屋を誹謗中傷する行為。
  • (4)生徒、第三者、もしくは当寺子屋に不利益を与える行為。
  • (5)メールアドレス又はパスワード及びその他個人情報を不正に使用する行為。
  • (6)選挙の事前運動、選挙運動又はこれらに類似する行為。
  • (7)有害なコンピュータプログラム等を送信又は書き込む行為。
  • (8)当寺子屋を利用した営利を目的、又は営利的色彩を帯びた行為。
  • (9)当寺子屋の目的に反するような行為又は書き込み行為。
  • (10)公序良俗に反する行為。
  • (11)犯罪的行為もしくはそれに結びつく又は引き起こす行為。
  • (12)宗教的又は政治的、営業的勧誘事項。
  • (13)その他、法令に反する行為や当寺子屋が不適切と判断する行為。

2.生徒が前項各号いずれかに該当する行為を行った場合、当寺子屋は参加資格を停止(退学)できるものとします。

第6条 (受講登録後のキャンセル)

1.参加料の入金後に発生したキャンセルについては以下の規定が適用されます。

  • (1)キャンセルの方法はインターナショナル寺子屋事務局への連絡によるものとします。
  • (2)お申し込み完了から開催14日前まではキャンセル料2,000円となります。
  • (3)開催13日前から開催7日前まではキャンセル料30%となります。
  • (4)開催6日前以降はキャンセル料100%となります。

第7条 (損害賠償)

1.生徒が第三者または当寺子屋、施設に対して迷惑行為や損害を与えた場合、当該生徒は自己の責任で問題・損害を解決するものとし、その損害を賠償するものとします。
2.生徒が参加中および公認活動中に事故・盗難被害にあう等により損害が生じた場合は、生徒および主催者は両者間で解決するものとし、当寺子屋は一切の責任を負いません。但し、当寺子屋の責に帰すべき事由により損害が生じた場合には、当寺子屋は、当該講義或いは公認活動の受講料相当額を限度として賠償責任を負うものとします。

第8条 (個人情報の取り扱い)

当寺子屋は、別途定める個人情報保護方針に従って、生徒の個人情報を適切に取り扱うものとします。

第9条 (著作権)

1.生徒は、当寺子屋のコースおよび公認活動を通じて提供されるいかなる情報、ソフトウェア、当寺子屋ロゴおよびロゴマーク等も、権利者の許諾を得ないで、転送、転載、複製、頒布、出版その他いかなる方法においても当該生徒の個人としての私的使用以外の使用はできないものとします。
2.当寺子屋は、生徒が発信したコメントその他の情報が、次のいずれかに該当する場合には、当該生徒に断りなくこれを停止・削除することができるものとします。

  • (1)生徒、第三者、もしくは当寺子屋の著作権その他の権利を侵害している、と認めた場合。
  • (2)生徒、第三者、もしくは当寺子屋の名誉もしくは信用を毀損していると認めた場合、または名誉もしくは信用を毀損しているとの警告、申し出等を第三者から受取った場合。
  • (3)日本または適用ある外国の法令に違反している、と認められた場合。
  • (4)裁判所、検察、警察その他国家機関等から法律に基づき削除するよう命令を受けた場合。
  • (5)その他、当寺子屋が不適切と判断した場合。

第10条 (譲渡禁止等)

1.生徒は、生徒として有する権利または義務を第三者に譲渡し、担保に供する等の行為はできないものとします。

第11条(変更の届出)

1.生徒は、当寺子屋への届出内容に変更があった場合、速やかに当寺子屋所定の方法で変更の届出をするものとします。
2.前項の届出がなかったことにより生徒が不利益を被った場合、当寺子屋は一切その責任を負わないものとします。

第12条 (コースの中断、延期、中止)

1.主催者の判断によりコースを中断、延期または中止する場合には、主催者および生徒は両者誠実な協議の上で対応方法を決定し、速やかに当寺子屋事務局に報告するものとします。
2.前項の対応に起因して生徒が被った損害について、当寺子屋は一切その責任を負わないものとします。

第13条 (当寺子屋の判断によるコースの中断、延期、中止)

1.当寺子屋は、以下のいずれかの事由が生じた場合には、生徒および主催者に事前に通知することなくコースを一時的に中断、延期できるものとします。

  • (1)設備等の保守を緊急に行う場合。
  • (2)火災、停電等により講義の提供ができなくなった場合。
  • (3)天災地変等の不可抗力によりコースの提供ができなくなった場合。
  • (4)その他、運用上または技術的に当寺子屋が講義の中断が必要と判断した場合。

2.当寺子屋は、前項によりコースの一時中断等が発生したとしても、これに起因して生徒および主催者が被った損害について一切その責任を負わないものとします。

第14条 (規約の変更)

1.当寺子屋では、生徒の了承を得ることなく本規約を変更・追加することがあります。変更後の規約は、生徒に掲示した時点より効力を生じるものとします。
2.強行法規の改定等により、本規約の一部が同法規に抵触する場合には、当該部分を同法規の定めに従い変更したものといたします。

第15条 (準拠法と裁判管轄)

1.本規約に関する準拠法は、すべて日本国の法令が適用されるものとします。
2.本規約に関するいかなる紛争も東京地方裁判所を第一審の専属的管轄裁判所とします。

Terms of Use

The following terms serve to outline the nature of the relationship between International TERAKOYA (referred to henceforth as TERAKOYA), the individual, group, or corporate body which has agreed to provide courses, lectures, events, and/or services to be carried out as part of TERAKOYA content and/or services (referred to henceforth as the Content Provider), and those students and/or participants whom of which wilfully consent to take part in activities, courses, events, and other services provided by TERAKOYA and/or Content Provider (referred to henceforth as The User).

1. About International TERAKOYA

A.) TERAKOYA has been designed to resemble a form of community-driven education and learning which disregards artificial barriers to learning and participation such as age, sex, and nationality, thus cultivating an environment where participants and members of that community can learn from one-another as a means of both personal and community development in a manner which current formal education systems and related administrations are unable to provide.
B.) The operation and administration responsible for the pursuit of this goal as it relates to TERAKOYA is handled by the International Terakoya Office of Operations (referred to henceforth as Office of Operations).
C.) The Office of Operation handles the following administrative services for the Content Provider.

  • i.) The enrollment and registration of The User.
  • ii.) Act as the responsible agent in the collection and management of funds
  • associated with content from the Content Provider in association with The
  • User and related operations.
  • iii.) TERAKOYA website management and related physical promotional
  • materials.
  • iv.) Ancillary and incidental administrative operations.

2. About the Content Provider

A.) The Content Provider may hold any variety of lectures, events, participatory and/or informative gatherings as a part of TERAKOYA content and service for The User.
B.) The Content Provider bears sole responsibility for all preparation and management of course content, including related safety measures.

3. Participation

A.) By agreeing to these Terms of Use and carrying out the specified processes for application, registration, and payment of appropriate funds for content provided by TERAKOYA and/or the cooperative efforts of TERAKOYA and a Content Provider, TERAKOYA will then formally acknowledge The User as holding the right to participate in the related, specified content.
B.) The User agrees to comply with these Terms of Use both throughout the period of formal registration as a participant in TERAKOYA content, as well as following completion of courses and/or content, as long as he/she is officially involved in and/or making use of TERAKOYA resources and/or services.

4. Ending Participation

A.) The right to participate in TERAKOYA content will be promptly and formally ceased without prior notice to The User in any of the following instances.

  • i.) The User knowingly provides false information to TERAKOYA.
  • ii.) The User has previously been found in violation of the Terms of Use which resulted in removal from TERAKOYA events, courses, and/or activities.
  • iii.) TERAKOYA determines that the action(s) of The User directly result(ed) in hindrance and/or damage to TERAKOYA and/or related management/operations, irrespective of cause.
  • iv.) The User is found to be in violation of the Terms of Use.
  • v.) Should TERAKOYA determine that The User is inelligible to participate in provided content and/or services.

B.) TERAKOYA bears no responsibility whatsoever in the event that The User should become unable to take part in TERAKOYA content for any of the reasons described in the preceding. TERAKOYA also bears no responsibility in the case of any damage, harm, or inconveniences to any third party should come about as a result of association and/or involvement with the The User in said cases. In the case that TERAKOYA or another third party incur damages, harm, or suffer inconveniences as a result of The User failing to adhere to any of the items in the preceding, any and all legal responsibility falls upon that of The User even after having withrawn from TERAKOYA content and services.

5. Prohibited Actions

A.) The following acts of The User are strictly prohibited.

  • i.) The User infringes upon the rights of TERAKOYA, Content Provider, and/or another third party, or if there is concern over such infringement taking place.
  • ii.) The User infringes upon the privacy of TERAKOYA, Content Provider, and/or another third party.
  • iii.) The User abuses TERAKOYA, Content Provider, and/or another third party.
  • iv.) The User is deemed to be a liability to TERAKOYA, Content Provider, or third party by any of these parties.
  • v.) Improper and/or unlawful use of mail address, password, and/or any personal information.
  • vi.) Any form of election campaigning or similar action.
  • vii.) Distribution and/or installation of malicious computer software, programs, and/or viruses.
  • viii.) Pursuit of commercial gain from TERAKOYA or similar/related actions.
  • ix.) Actions which contradict the goals of TERAKOYA.
  • x.) Actions which oppose public order.
  • xi.) Criminal acts or other such acts which may be associated with or lead to criminal acts.
  • xii.) Religious, political, and/or corporate solicitation.
  • xiii.) Any other unlawful act which is in opposition to laws and ordinances, or any act so deemed by TERAKOYA.

B.) TERAKOYA reserves the right to withdraw The User from any and all content should The User be found in violation of any one of the actions outlined in the preceding.

6. Cancellation Following Formal Registration

A.) The following rules and regulations apply in instances where The User cancels his/her participation (i.e. personally elects to withdraw from and cease to participate) in TERAKOYA content following the disbursement of related funds to cover designated costs for said content.

  • i.) The User must contact the Office of Operations in charge of managing
  • course/content registration in order to formally declare his/her desire to
  • cancel his/her registration, and therefore participation in the related content.
  • ii.) Cancellation fees are not incurred on the part of The User in cases where
  • the cancellation process is carried out in full at least 72 hours prior to the
  • date and time of the scheduled course/content.
  • iii.) Cancellations which take place within 72 hours of the date/time which the
  • related course/content is scheduled to be carried out will incur a
  • cancellation fee of 100% on side of The User. In other words, any and all
  • funds transferred to TERAKOYA for participation in the related
  • course/content cannot be refunded.

7. Restitution

A.) Should The User be responsible for damage to TERAKOYA, The Provider, an involved third party, and/or the facilities and/or belongings associated with any of the above, The User associated with the problem/incident will be held fully responsible for full compensation of those damages.
B.) In the case that The User is involved in an incedent either during TERAKOYA-operated content or during officially approved or endorsed activities where The User suffers damages, such as being the subject of theft, physical harm, or other damaging acts, it is the responsibility of The User to settle the matter in a fair and reasonable manner with the involved party, whether it be The Provider or another third party. TERAKOYA bears no responsibility whatsoever for related damages associated with the incident. However, in the case that the cause of damages is attributable to TERAKOYA, TERAKOYA will return to The User course fees to a sum befitting the damages incurred.

8. Handling of Personal Information

TERAKOYA vows to responsibly handle and manage the personal information of The User in a manner in-line with company policy as outlined in separate documentation.

9. Copyrights

A.) The User is permitted to use any materials and/or information distributed by TERAKOYA for TERAKOYA-related courses, events, and/or officially sponsored activities, including but not limited to information, software, the TERAKOYA logo, TERAKOYA-related branding, etc. solely for personal use. Any transfer, publication, reproduction, distribution, printing, and/or sale of these materials and/or content without the expressed written consent of the copyright holder is strictly prohibited and may be subject to legal action.
B.) In the case that The User publicly comments and/or shares information about TERAKOYA which TERAKOYA interperets to fall into one of the categories below, The User must promptly comply should TERAKOYA request that The User cease and/or remove said comments, statements, and or information.

  • i.) The information shared infringes upon the copyright(s) or other rights of TERAKOYA, a third party, or The User.
  • ii.) Statements and/or information seeking to harm TERAKOYA, The User, or a third party, or statements and/or information of such nature which have been received from a third party with the purpose of seeking harm and/or damaging the credibility or reliablility of TERAKOYA, The User, or a third party.
  • iii.) Statements found to be in opposition to the laws and ordinances of the nation of Japan or associated overseas nations.
  • iv.) There has been a formal request from the court, police, official inspection officer(s), or other operations of The State to remove and/or cease statements as part of legal compliance.
  • v.) Other cases which TERAKOYA deems the statements/actions under question to be damaging, inaccurate, and/or for other reasons inappropriate, and hence reasonable to demand the cease and/or removal of related information.

10. Non-negotiable Transfer

A.) The User is not permitted to transfer rights, responsibility, or burden of any sort to a third party, or carry out any actions attempting to use any of the above as a form of collateral.

11. Notification of Changes

A.) In the case that there is a change or alteration with regards to information being sent to TERAKOYA, The User is required to notify TERAKOYA in a timely manner via appropriate means outlined by TERAKOYA.
B.) TERAKOYA bears no responsibility whatsoever should The User suffer penalty due to the failre to notify TERAKOYA of said changes and the related information as outlined in the previous clause.

12. Suspension, Postponement and Cancellation

A.) In the case that The Content Provider deems it necessary to suspend, postpone, or cancel a course, all negotiation associated with the handling of said case is to be carried out and resolved in good faith between The Content Provider and The User. Both parties are then required to promptly report on the terms of resoultion to the Office of Operations.
B.) TERAKOYA bears no responsibility whatsoever in the case that The User suffers damages somehow tied to the nature of the resolution as outlined in the previous.

13. Suspension, Postponement and Cancellation by TERAKOYA

A.) TERAKOYA reserves the right to suspend, postpone or cancel any hosted content without any prior notice given to The User or The Content Provider in any of the following instances.

  • i.) If there is a need for emergency maintenance and/or repair to any necessary tools and/or facilities.
  • ii.) Fire, power outage, or any other unforseeable situation and/or occurrence resulting in TERAKOYA's inability to carry out the scheduled content.
  • iii.) Natural disaster or any other uncontrollable, unforseeable occurrence resulting in TERAKOYA's inability to carry out the scheduled content.
  • iv.) Any other operation and/or technical issues forcing TERAKOYA to suspend operation.

B.) TERAKOYA bears no responsibility for any damages incurred by The User or The Content Provider as a result of any form of suspension outlined in the previous.

14. Alterations to Terms of Use

A.) Any alterations, whether changes, additions, or removal of terms made to these Terms of Use go into effect immediately following their open publication and can be carried out without the notification, acknowledgement and/or agreement of The User.
B.) Should alterations be made to these Terms of Use due to forced compliance with applicable laws, and should a portion of these Terms of Use later be found to be in some way in violation of the same laws to which they were altered in order to reflect compliance, the section of the terms in question shall be altered to reflect accurate compliance of the laws in question.

15. Basis and Jurisdiction

A.) The basis of these Terms of Use are written to reflect the laws and ordinances of the nation of Japan.
B.) Any and all disputes resulting in legal proceedings which arise in relation to these Terms of Use are to be processed and handled by a district 1 courthouse within the Tokyo judicial system under exclusive jurisdiction.
